After many complaints by citizens that they were stopped due to racial profiling instead of a traffic violation, one Sheriff is investigating. At every traffic stop, the police officer is required to record and report the race of the person stopped; however, many claim that the police officers were purposely recording a different race to cover up their racial profiling. It is unclear as to whether the mislabeling of race was due to a mistake or a cover up. The investigation continues. Read the whole story here. |

The 2nd District Appellate Court handed down an opinion recently that rules in DUI Defendant's favor. If the Police have a video of the stop and the DUI Defendant's performance of Field Sobriety Tests, then the Police should produce that video. In fact, if the Police fail to produce the video, then the Trial Court should presume that the video shows the DUI Defendant performing the Standardized Field Sobriety Tests well. The Prosecutor's have decided that at least 3 of the charges initially filed against former Governor Blagojavich are going to be dropped. From the juror's comments in the first trial, the counts were too complicated. The dropping of these counts will eliminate 30 pages of complicated jury instructions. Read the whole story here. |

The Illinois Secretary of State randomly sends out letters to drivers to check people for their proof of insurance. The SOS will send the letter to the address they have for you. If your address is not current, you may not receive the letter from the SOS. However, you are obligated to respond to the letter from the SOS; if you fail to respond, your license will be suspended. Keeping your address up-to-date with the SOS will ensure that you receive the letter requesting your proof of insurance and will prevent you from incurring an unknown suspension on your license. |
